Terms of Use

Jurisdiction: Brazil. Elected forum: Comarca de Sorocaba/SP. By creating an account or using Patensify, you agree to these Terms. If you do not agree, do not use the service.

1. Who we are and what we offer

Patensify is a service operated by F.A. RAMOS DESENVOLVIMENTO DE SOFTWARE LTDA, CNPJ 62.243.574/0001-48. We offer an intelligence platform about your Instagram audience’s attention — we organize public data about your profile to generate private insights about who pays attention to you.

Patensify is not affiliated with, associated with, endorsed by or sponsored by Instagram, Meta or any subsidiary. “Instagram” is a trademark of Meta Platforms, Inc.

2. Registration and account

  • You must be 18 or older.
  • Registration information must be truthful and up to date.
  • Each account belongs to one person or entity — sharing credentials violates these Terms.
  • You are responsible for everything that happens under your account. Notify us at support@patensify.com in case of unauthorized access.

3. Plans and payment

Patensify is offered on the Creator plan, with prices and features listed on the pricing page. Business, Agency and Enterprise plans are future horizons and are not yet commercially available.

  • Recurring monthly billing, in Brazilian Real (BRL), via a contracted payment provider.
  • Annual subscriptions receive a discount as disclosed on the pricing page.
  • Automatic renewal until cancellation.
  • Price changes: communicated at least 30 days in advance. You may cancel before the new charge.
  • Cancellation: available at any time inside the app. You keep access until the end of the period already paid; no pro-rata refund, except where required by law.
  • Right of withdrawal: within the first 7 days after the first charge, you may request a full refund via support@patensify.com (Art. 49 of the Brazilian Consumer Code).

4. Acceptable use

You agree not to:

  1. Use Patensify to violate any law, regulation or third-party right.
  2. Extract data from the service by automated means (scraping, bots) beyond the limits of the official API, where available.
  3. Resell, sublicense or redistribute Patensify insights as if they were your own product, except under an Agency / Enterprise agreement.
  4. Attempt to identify pseudonymized individuals, reverse-engineer algorithms, or circumvent technical protections.
  5. Use Patensify to harass, stalk, blackmail or discriminate against any person — including people whose public interaction on Instagram feeds the service.
  6. Connect Instagram accounts you do not legitimately control.

Violation may result in immediate suspension, account termination and, where applicable, civil and criminal liability.

5. Instagram data and Meta compliance

  • Patensify operates exclusively on public data from Instagram accessed with your authorized connection.
  • We follow the applicable Meta Platform Terms. If Meta changes access rules, we adjust the service and inform you.
  • If Instagram suspends or revokes your account’s connection, the service is interrupted until reconnection — this is not a breach on our part.

6. Intellectual property

  • Patensify: all software, brand, design, algorithms and documentation are owned by Patensify.
  • Your data: you retain all rights over your account data and the content you produced on Instagram. You grant us a limited, non-exclusive license to process this data for the sole purpose of providing the service.
  • Generated insights: you may freely use the insights shown about your own audience, including share cards. Patensify retains the right to use aggregated, anonymized versions to improve the product and publish market statistics.
  • Feedback: ideas, suggestions and feedback you share with us may be used freely by Patensify to improve the service, without obligation, attribution or compensation.

7. Privacy

The processing of personal data is governed by the Privacy Policy, which is an integral part of these Terms.

8. Availability, maintenance and service changes

  • Patensify is provided “as is”. We make reasonable efforts to keep the service available, but we do not guarantee 100% uptime.
  • We may update features, remove functionality or adjust plan limits. Material changes that reduce contracted value are communicated with reasonable advance notice.
  • Scheduled maintenance is announced when possible.

9. Limitation of liability

To the maximum extent permitted by Brazilian law:

  • Patensify is not liable for business decisions made based on the service’s insights. Insights are a probabilistic interpretation, not a guarantee of results.
  • We are not liable for unavailability caused by third parties (Instagram/Meta, internet provider, payment provider).
  • Our total liability, in any event, is limited to the amount you actually paid in the 12 months prior to the event giving rise to the claim.

These limitations do not apply to damages caused by willful misconduct or gross negligence, or to rights guaranteed by the Brazilian Consumer Code that cannot be waived by contract.

10. Termination

  • By you: at any time, via the app or email. Data deletion follows the Privacy Policy.
  • By us: we may terminate your account for violation of these Terms, default for more than 30 days, or a decision to discontinue the service. Communicated by email to the last registered address.

Termination does not affect obligations already due (outstanding amounts, for example).

11. Changes to the Terms

We may update these Terms. Material changes are communicated by email and in the app at least 15 days in advance. Continuing to use the service after the effective date means acceptance. If you do not agree, close your account before the effective date.

12. Governing law and forum

These Terms are governed by the laws of the Federative Republic of Brazil. The forum of the Comarca de Sorocaba/SP is elected to settle any dispute — without prejudice, however, to the consumer’s right to file suit in the forum of their own domicile (art. 101, I, of the Brazilian Consumer Code).

13. General provisions

  • Force majeure: neither party is liable for failures arising from events beyond its reasonable control (act of God or force majeure, art. 393 of the Brazilian Civil Code) — including third-party failures (Instagram/Meta, providers), internet or power outages.
  • Assignment: Patensify may assign these Terms to a successor or in a corporate reorganization, preserving the protections set out here; you may not assign your account to third parties without our consent.
  • Severability: if any clause is held invalid or unenforceable, the remaining clauses stay in full force.
  • Entire agreement: these Terms and the Privacy Policy constitute the complete agreement between you and Patensify regarding the service.
  • No waiver: tolerance of any breach does not mean a waiver of rights nor changes these Terms.
